1. Agreement and scope
These Terms & Conditions (the Terms) are an agreement between you and Aerobase Innovations AB (Aerobase, we, us, or our) for the Phases service, website, APIs, documentation, and related software (together, the Service).
By creating an account, accepting an invitation, accessing a workspace, or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you use the Service for an employer or another organisation, you confirm that you have authority to bind that organisation. If you do not agree, do not use the Service.
A signed order form, enterprise agreement, or other written agreement with Aerobase may add to or replace parts of these Terms. If there is a conflict, that written agreement controls for the services it covers. Mandatory rights under applicable law are not limited by these Terms.
2. Accounts and workspaces
You must provide accurate account information, keep your credentials secure, and promptly tell us if you suspect unauthorised use. You are responsible for activity carried out through your account unless it results from our failure to use reasonable security measures.
Workspace owners and administrators control membership, roles, enabled features, and workspace content. If you join an organisation workspace, that organisation may access and manage content you place there. Follow its policies and use a personal workspace for content that should not be controlled by the organisation.
The Service is intended for professional or educational use. You must have the legal capacity to agree to these Terms. If you use the Service for an organisation, you must also have authority to act for it.
3. Permitted use
You may use the Service only lawfully and in accordance with these Terms, applicable documentation, workspace permissions, and usage limits. You must have the rights and permissions needed for every prompt, file, material definition, dataset, instruction, and other content you submit.
You must not:
- use the Service to violate law, third-party rights, sanctions, or export-control requirements;
- upload malware, credentials, unlawfully obtained data, or content that infringes intellectual-property or privacy rights;
- bypass access controls, rate limits, workspace isolation, safety controls, or usage restrictions;
- probe, disrupt, overload, or gain unauthorised access to the Service or another user's data;
- misrepresent generated output as independently verified, certified, or endorsed by Aerobase; or
- use the Service or its output to develop, manufacture, or operate a system where an error could reasonably cause death, personal injury, or major environmental or property damage without qualified human review and appropriate independent validation.
4. Engineering simulations and AI-generated output
Phases combines language models, numerical models, material data, and software tools. Outputs can be incomplete, inaccurate, non-unique, outdated, or unsuitable for your specific material, process, geometry, boundary conditions, equipment, or safety factors. A plausible answer is not proof that a model is valid for your case.
The Service is a decision-support tool, not a substitute for a qualified engineer, laboratory testing, process qualification, regulatory review, or an organisation's own verification and validation procedures. You are responsible for reviewing inputs, assumptions, units, model limits, convergence, uncertainty, and outputs before relying on them. Do not use an output as the sole basis for a safety-critical, production, compliance, or investment decision.
Documentation may describe validation ranges and known limitations. Those descriptions apply only to the stated versions and conditions; they are not a guarantee for other cases.
5. Your content
As between you and Aerobase, you retain ownership of content you submit and of any rights you may have in outputs. You grant Aerobase a limited, worldwide, non-exclusive licence to host, copy, transmit, process, display, and otherwise use that content only as needed to provide, secure, maintain, and troubleshoot the Service, comply with your instructions, and meet legal obligations.
You decide what to submit. Do not provide trade secrets, export- controlled data, personal data, or other confidential material unless you are authorised to do so and your agreement and workspace are appropriate for that material. Shared-chat links make the selected conversation available to anyone who has the link until the chat is deleted. Phases does not currently provide a separate unshare control, so do not create a shared link for content that should remain private.
Feedback and suggestions may be used without restriction or payment, but we will handle personal data within them under the Privacy Policy. A bug report is stored for private administrator review and is not automatically published to a public issue tracker.
6. Our service and intellectual-property rights
Aerobase and its licensors own the Service, its software, branding, designs, documentation, model implementation, and other protected materials, excluding your content and third-party components. These Terms give you a limited, revocable, non-exclusive, non-transferable right to use the Service; they do not transfer our intellectual property to you.
Any open-source component remains governed by its own licence. Except where law or an applicable open-source licence permits it, you may not copy, sell, sublicense, reverse engineer, or create derivative works from the Service.
7. Third-party services and integrations
The Service relies on third-party infrastructure, identity, storage, email, and AI providers and may let you connect external tools. Their services can have separate terms and privacy notices. You are responsible for authorising an integration and for the instructions and data you send through it. We are not responsible for a third party's independent acts or services, but we remain responsible for our own obligations when a provider processes data on our behalf.
8. Availability, limits, and changes
We aim to operate the Service reliably, but it may be interrupted by maintenance, security work, provider failures, capacity limits, or events outside our reasonable control. Features may be experimental, changed, limited, or discontinued. We will give reasonable notice of a material reduction where practicable and where an applicable agreement requires it.
9. Suspension and termination
You may stop using the Service at any time. You can delete individual chats and runs through available controls and can ask us at support@aerobase.se for help exercising account or data rights.
We may restrict or suspend access when reasonably necessary to protect the Service or others, investigate suspected misuse, comply with law, address non-payment under a commercial agreement, or enforce these Terms. Where appropriate, we will provide notice and an opportunity to resolve the issue. Sections that by their nature should survive termination—including ownership, disclaimers, liability, and dispute terms—continue to apply.
10. Warranties and disclaimers
The Service is provided on an as available basis. To the maximum extent permitted by law, Aerobase disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and that outputs will be accurate or uninterrupted. Nothing in these Terms excludes a warranty or remedy that cannot lawfully be excluded. Any express service commitment in a signed agreement remains unaffected.
11. Liability
Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence where applicable.
To the maximum extent permitted by law, neither party is liable under these Terms for indirect or consequential loss, loss of profit, revenue, goodwill, anticipated savings, or data, or for business interruption. Aerobase is not liable for decisions made solely from unverified Service output or for content and configurations supplied by you.
12. Governing law and disputes
Swedish law governs these Terms, unless mandatory choice-of-law rules require otherwise. Disputes may be brought before a competent Swedish court unless mandatory law gives you the right to bring a claim elsewhere. Before filing a claim, please contact us so we can try to resolve the matter informally.
13. Changes and contact
We may update these Terms to reflect changes in the Service, law, or security requirements. We will post the updated version and change the date above. If a change materially affects your rights, we will provide additional notice where reasonably practicable. Continued use after the change takes effect means you accept the revised Terms; where law requires fresh consent, we will ask for it.
